Heather Antoine was recently quoted in Bloomberg’s article examining the leading copyright cases we can expect in the New Year. One of the major cases is Andy Warhol Foundation v. Goldsmith, which will determine whether Andy Warhol’s prints of Prince infringed upon Lynn Goldsmith’s initial copyrighted photographs.
This case may redefine fair use for the first time in almost 30 years. Heather explained that if the Supreme Court's decision tightens up the definition of transformative use, “It will trickle down.” She continued by stating, “This is one of those things that comes up every day, and in copyright cases constantly.”
