The National Law Review recently published Roger Lee and Ani Petrosyan’s article “The FDA’s Proposed Rule on Food Labeling: Nutrient Content Claims and Definition of ‘‘Healthy,’’ which examined the U.S. Food and Drug Administration (FDA)’s move to crack down on the descriptor of “healthy.” If passed, this rule will revise the criteria of “healthy” requiring products to contain a certain amount of food from at least one of the outlined food groups or subgroups.
This move will ensure accurate labeling of products in conjunction with current nutrition science, empowering consumers to make more informed decisions. Though, the ruling raises concerns from many manufacturers about how this will impact their branding. Roger and Ani explained, “a number of notable comments criticized the FDA for overreaching and being too rigid in its approach,” which may be taken into account through revision at the conclusion of the question period.
